Subclass 188A /888A visa Business Innovation stream
This visa is ideal for small and medium enterprise owners overseas, as it has the lowest investment threshold of all business visas, and it allows various types of business activities.
You can bring eligible members of your family with you on this visa and remain in Australia for up to 4 years and 3 months. If you need more time to apply for permanent residence, you can apply for a subclass 188 visa Business Innovation Extension stream to extend your stay in Australia.
You shall carry out business and investment activity in Australia for at least two years. When certain criteria are met, you can apply for permanent residency through subclass 888 visa Business Innovation stream.
188A General Eligibility Criteria
You must be under 55 at the time of the invitation to apply for the visa.
You must have a successful business career and a genuine desire to continuously own and manage a business in Australia.
You or you and your partner combined must have total net business and personal assets of at least AUD800,000. Your funds must be available to transfer to Australia within 2 years of us granting the visa.
For 2 out of 4 fiscal years immediately before you receive an invitation to apply, you must have had an ownership stake in 1 or 2 businesses that had at least AUD500,000 turnover in each of those 2 years.
You must own at least:
-51%, of the total value of the business if the business has a turnover of less than AUD400,000 per year
-30%, of the total value of the business if the business has a turnover of AUD400,000 or more per year, or
-10%, of the total value of the business if the business is operated by a publicly listed company
*You must score at least 65 points on the points test.
888A visa General Eligibility Criteria
You must be able to show that you (or you and your partner together) have:
-
had an ownership interest and a direct and continuous management role in an actively operating main business or main businesses in Australia for the two years immediately before you apply.
-
had an annual turnover of at least AUD300 000 from the main business or businesses in the 12 months before you apply.
-
owned at least one of the following percentages of the main business (or main businesses) in Australia in the year immediately before you apply:

51 % of a business with a turnover of less than AUD400 000 per year
-
30 % of a business with a turnover of AUD400 000 or more per year
-
10% cent of a publicly listed company
-

If you bought your main business (or businesses) from a person who applied for or held a Business Innovation and Investment (subclass 888) visa or a permanent business skills visa (in subclasses 890, 891, 892 or 893) at the time of the acquisition, you must show that you and that person co-owned the business for at least 1 year before you apply.
You (or your partner, or you and your partner together) must also demonstrate that you have achieved at least two of the following requirements:

a net value of business assets of at least AUD200 000 in your nominated main business (or two main businesses) in Australia throughout the year immediately before you apply

a net value of personal and business assets of at least AUD600 000 in Australia throughout the year immediately before you apply

employed at least the equivalent of two full-time employees in your main business (or main businesses), throughout the year immediately before you apply who are:

Australian citizens, Australian permanent residents, or holders of valid New Zealand passports

not your family members.

Subclass 188B/ 888B visa Investor Stream
188B General Eligibility Criteria
For the 2 fiscal years immediately before the applicant is invited to apply for this visa, the applicant or the applicant and his/her partner together, have business and personal assets with a net value of at least AUD2.25 million. These assets must have been lawfully acquired and be available for transfer to Australia within 2 years of the visa being granted.
The applicant must have at least 3 years' experience and a successful record of managing one or more qualifying businesses or eligible investments
After lodging the visa application, the applicant must make a designated investment of at least AUD1.5 million in the State or Territory in which the nominating State or Territory government agency is located. The investment must be made from unencumbered funds generated from qualifying businesses or eligible investments.
For at least 1 of the 5 fiscal years, the applicant has either managed a qualifying business in which the applicant, the applicant’s partner or they combined had at least 10% ownership interest, or an eligible investment of at least AUD1.5 million owned by the applicant, the applicant’s partner or they combined.
*The applicant must score at least 65 points on the points test.
888B General eligibility criteria
The applicant must hold the designated investment for at least 4 years from the date the investment certificate is issued by your nominating State or Territory, and you must have lived in Australia for at least 2 of the 4 years immediately before you apply.
Subclass 188C/888C visa Significant Investor stream
The applicant must make a complying significant investment of at least AUD5 million and must have a genuine intention to hold that investment for at least 4 years. There is no age limit, no english requirement or skill points threshold for188A visa Significant Investor stream, and the processing time is very quick.
To be eligible for subclass 888C visa, the applicant must have held the complying investment for 4years, and either the applicant or the applicant’s spouse must have been in Australia for certain number of days to satisfy the residence requirement, i.e. 160 days for the applicant, or 720days for the applicant’s spouse. Time spent in Australia is calculated cumulatively, which allows the visa holder a flexible living arrangement.
Subclass 132 Business Talent visa
Business Talent Visa (Subclass 132) is the only business visa that offers one-step migration pathway. Subclass 132 visa comprises of two streams:
❏ Significant Business History stream
General Eligibility Criteria:
You, or you and your partner combined, must have at least a total net assets worth AUD1.5
million and is available for transfer to Australia within 2 years after the visa is granted.
You must have total net assets worth AUD400,000 or more from the ownership interest in one or
more qualifying businesses,gained over at least 2 of the 4 fiscal years immediately before you
were invited to apply for this visa.
For at least 2 of the 4 fiscal years immediately before you were invited to apply for this visa,
your total annual turnover must be at least AUD3 million from at least 1 business and no more
than 2 businesses
Your ownership interest must be either:
51% or more of a business with turnover of less than AUD400,000 per year
30% or more of a business with turnover of more than AUD400,000 per year, or
10% or more of a publicly listed company
❏ Venture Capital Entrepreneur stream
This visa is for people who have sourced venture capital funding from a member of the Australian Investment Council (AIC). The visa lets you operate a new or existing business in Australia.
You must have secured at least AUD1 million in funding for a high-value business idea
from an Australian venture capital firm which is a member of the Australian Investment Council
(AIC). The category of membership must be that of Venture Capital Membership.
The funding must be for:
-business development or expansion of a business in Australia
-the commercialisation of a product in Australia
-early phase start-up of a business in Australia
